Please accept this email from the Cumberland County Prosecutors Office as
a reasonable seven business day extension on the time frame for responding
to your OPRA request, which was posed on November 9, 2023. On November 13,
2023, a clarification request was sent to you via email, where your
original records request merely requested: “3/15/21 to 4/15/21; 8/9/21 to
9/9/21; 8/1/23 to 8/28/23”. In the interest of transparency, it is my
assumption that the records you are requesting are the same records you
requested in your most recent OPRA request, dated October 20, 2023, which
was emails to and from Harold Shapiro utilizing the keyword “Dante Hayes”
occurring during specified time periods. In the absence of any
clarification provided by you to my prior request for clarification, I
will proceed with this request under the assumption that you are
requesting currently all emails to or from Harold Shapiro utilizing the
keyword “Dante Hayes” which occur during the time periods: 3/15/21 to
4/15/21; 8/9/21 to 9/9/21; 8/1/23 to 8/28/23.
As this request will require the review of numerous responsive records, a
seven business day extension will be required in this matter. Accordingly,
you can expect to receive a response to your request, as well as all
responsive records, on or before Friday, December 1, 2023.

The dates I requested on 10/20/23 were 5/28/22 - 6/28/22, 10/11/22-11/1/22, and 12/20/22-1/20/23, and the dates I requested on 10/26/23 were 3/15/21-4/15/21, 8/9/21-9/9/21, and 8/23-8/28/23. Therefore they are not the same, and I have not received anything in regards to my request on 10/26/23.
Due to the nature of the documents requested, I ask that you expedite the matter. However, the December 1,2023 date given is in violation of the 7 days/extension under O.P.R.A. rules

With regard to your OPRA request dated October 20, 2023, for the following records: “Emails To and From Assistant Prosecutor Shapiro including TO, FROM, SUBJECT, DATE, TIME AND ATTACHMENTS regarding Dante Hayes from: 5/18/22 to 6/28/22; 10/11 to 11/11/22; 12/20/22 to 1/20/23”, the response of the Cumberland County Prosecutor's Office was sent to you via email to the provided email address of '[email address]' on October 31, 2023, which is not in violation of the seven business days provided for responding to an OPRA request under the provisions of the Open Public Records Act.
With regard to your second OPRA request, you are presently claiming that that request was dated October 26, 2023 and was for the following records: "3/15/21 to 4/15/21; 8/9/21 to 9/9/21; 8/1/23 to 8/28/23". Our records instead reflect that this OPRA request was submitted by you on November 9, 2023, at exactly 5:17 P.M. via the email address: '[OPRA #55163 email]'. Accordingly, the original seven business day due date for responding to this request was yesterday, November 21, 2023. However, on November 17, 2023, having obtained your unredacted responsive records and seeing that reviewing these voluminous records would require additional time in order to perform necessary review prior to release, I sent an email to your provided email address of '[OPRA #55163 email]' informing you of the need for a reasonable seven business day extension on the time frame for responding to your OPRA request, as provided under the provisions of the Open Public Records Act. I am writing to request an internal review of Cumberland County Prosecutor's Office's handling of my OPRA request 'Assistant Prosecutor's Shapiro;s TO, FROM, DATE ,TIME E-Mails of the dates requested'.
On 12/1/23 I finally received a response to my request for the dates requested. However, there are no emails from 3/15/21 to 4/15/21 or 8/8/21 to 9/9/21. I have received emails for 8/1/23 to 8/28/23. However I have received 3 attachments for this one month period consisting of (A) 140 pages, (B) 127 pages and (C) 102 pages. While reading through the emails I came across numerous duplicates. 8/2/23 10:16 am the same email from Holly Moore is used for Pages #6, 15,26,43,55,68,79 and 90. On 8/21/23 at 2:36 pm an email from Holly Moore was used in pages #14,25,67,77 and 88
At this point I am requesting that my original dates of 2021 be received. Thanks

You appear to be asserting that error occurred in the response dated December 1, 2023, to your OPRA request dated November 9, 2023, for the following records: Emails to and from [email address], which utilize the keyword: "Dante Hayes", which occurred from 3/15/21 to 4/15/21, 8/9/21 to 9/9/21, and 8/1/23 to 8/28/23. Your identified error appears to be the fact that there were no emails in the provided responsive records which occurred during the time periods of 3/15/21 to 4/15/21, or 8/9/21 to 9/9/21, and that there were apparent duplicates in the included responsive records provided.
The reason there were no responsive emails for the time periods of 3/15/21 to 4/15/21 or 8/9/21 to 9/9/21 is because there were no responsive records for any emails matching your requested parameters occurring during those two time periods. The reason there are duplicate emails in the responsive records provided is because emails sent or received during that time period were often in response to an ongoing email chain and included every email that occurred previously in that email chain as part of the body of that email. I do not make redactions to responsive records which are not provided for by an exemption to the Open Public Records Act, so I do not redact these email chains as they are emails responsive to your request and are not covered by an exemption to OPRA that would permit me to redact them from your responsive records.
