On October 28, 2024 I emailed you requesting response to the following
questions:
Pursuant to N.J.S.A. 47:1A-5, a request for government records is
incomplete and therefore may be denied where the requestor has failed to:
- certify whether the government record is being sought in connection with
a legal proceeding and identify the proceeding. N.J.S.A. 47:1A-5(g).
- certify whether the requestor has been convicted of any indictable
offense under the laws of this State, any other state or the United
States. N.J.S.A. 47:1A-2.2.
- certify whether the requestor will/will not use the requested government
records for a commercial purpose. N.J.S.A. 47:1A-1.1
Additionally I am requesting your clarification on the nature of your
request. The Freedom of Information Act applies to federal agencies. I
am attempting to ascertain if the Freedom of Information Act is the method
that you wish to request these records? Please note that per Bradley
Peterson v. New Jersey Department of Corrections (2011), the Freedom of
Information Act does not fall under the authority of the Government
Records Council (GRC), the Council will not consider whether the Custodian
should have disclosed the records pursuant to the Freedom of Information
Act. N.J.S.A. 47:1A-7b.

My office is in receipt of your request for records pursuant to the
“Freedom of Information Act” dated October 25, 2024. The request was
received on October 28, 2024. As such, the seven (7) business day
deadline to respond to your request is November 6, 2024. This response is
being provided on the Seventh (7^th) business day since the Township
received said request.
On October 28, 2024 I contacted you via email at
[OPRA #68268 email] in an attempt to
request your certification on the following questions:

To date I have not received a response from you. On October 30, 2024, an
email was sent, again in an effort to ascertain a certification of the
required questions and also to seek clarification since you made your
request under the Freedom of Information Act, which is only applicable to
Federal agencies. To date I have yet to receive a response. Without this
required information I am unable to process your request and for that
reason your request is denied.
If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the [insert name of agency] to deny
access. At your option, you may either institute a proceeding in the
Superior Court of New Jersey or file a complaint with the Government
Records Council (“GRC”) by completing the Denial of Access Complaint
Form. You may contact the GRC by toll-free telephone at 866-850-0511, by
mail at P.O. Box 819, Trenton, NJ, 08625, by e-mail at
[email address], or at their web site at www.state.nj.us/grc. The
Council can also answer other questions about the law. All questions
regarding complaints filed in Superior Court should be directed to the
