Good Afternoon,
The Freedom of Information Act, which is codified at 5
U.S.C.S. 552 applies to only Federal Agencies and does not
create a right of access to records held by Congress, the
courts, or by state or local government agencies. Bridgewater
Township is a local government within the Stare of New Jersey
and therefore is not subject to the provisions of the FOIA.
However, the State of New Jersey has legislation similar to
FOIA called Open Public Records Act (OPRA), which codified at
N.J.S.A. 47:1A-1.1. The records custodian will respond to your
request for government record in accordance with OPRA.
Your request included three specific records related to a
criminal matter identified by an arrest date of July 16, 2024
and incident number 24220775.
1,Arrest Report.
2 Incident Report.
3 Mugshot.
Attached you will find a copy of the Incident and Arrest
reports. Certain information has been redacted from this
report in accordance with N.J.S.A. 47:1A-3. "Ongoing
Investigation" exception/ access to certain information
related to a criminal investigation.
Your request for the Mugshot is denied. Pursuant to Executive
Order #69 (Whitman) and Melton v. City of Camden GRC complaint
number 2011-233, Mugshots are not available for public access
in the State of New Jersey.
