Good afternoon, Carli Ratke.  Frank Tracey writing from the Fairfield
Township Police Department.  I am the Lieutenant in charge of the
Administrative Section here at the police department and oversee the
Records Bureau.
 
My office is in receipt of your request for records pursuant to the Open
Public Records Act (NJSA 47:1A-1) sent by email (copied below) regarding
Fairfield Police Department case number 24-11401 on April 14, 2024.
The Arrest Reports are disclosable under OPRA.  Redacted versions have
been attached to this email.
Regarding the Incident Report and Mugshots, the records you requested are
criminal investigatory in nature and not required by law to be made,
maintained or kept on file by the police department.  Such records are
not subject to disclosure under OPRA.  For these reasons, your request is
denied.
If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the FAIRFIELD POLICE DEPARTMENT to deny
access.  At your option, you may either institute a proceeding in the
Superior Court of New Jersey or file a complaint with the Government
Records Council (“GRC”) by completing the Denial of Access Complaint
Form.  You may contact the GRC by toll-free telephone at 866-850-0511, by
mail at PO Box 819, Trenton, NJ, 08625, by e-mail at

The Council can also answer other questions about the law.  All questions
regarding complaints filed in Superior Court should be directed to the
