The Clark Police Department received your Open Public Records Act (OPRA)
request on 6/25/2024.
The official Records Custodian, Joann Concina received your OPRA request
on 6/25/2024.
As such, the seven (7) business day deadline to respond to your request is
July 7, 2024.
This response to your request is being provided to you on the second
business day after the custodian’s receipt of said request. 
 
Your OPRA request sought access to the following: "I am writing to request
access to and copies of records Freedom of Information I am seeking
information related to an arrest that occurred on 16-02-2021 associated
with the Incident number #21-02957. Please include all relevant documents,
reports, and any other information pertaining to this arrest. If there are
any fees for searching or copying these records, please inform me,
However, I would like to request a waiver of all fees in that the
disclosure of the requested information is in the public interest and will
contribute significantly to the public's understanding of the operations
or activities of the government." 
The records requested are being denied. 

 1. N.J.S.A. 47:1A-1 (Legislative Findings) 24) Privacy Interest - “a
public agency has a responsibility and an obligation to safeguard from
public access a citizen's personal information with which it has been
entrusted when disclosure thereof would violate the citizen's
reasonable expectation of privacy.”

      2) The following records shall not be considered to be government
records subject to public access pursuant to N.J.S.A. 47:1A-1 et seq., as
amended and supplemented:
      Information concerning individuals as follows: Information relating
to medical, psychiatric or psychological history, diagnosis, treatment or
evaluation.
   
    3)Your request for “information related to an arrest that occurred on
16-02-2021 associated with the Incident #21-022957” “all relevant
documents” and “any other information related to this arrest” is denied.
“[A]proper request under OPRA must identify with reasonable clarity those
documents that are desired, and a party cannot satisfy this requirement by
simply requesting all of an agency’s documents.” See Bent v. Stafford
Police Dept., 381 N.J. Super. 30, 37 (App. Div. 2005). A proper OPRA
request must state "a specific subject matter that [is] clearly and
reasonably described with sufficient identifying information." Burke v.
Brandes, 429 N.J. Super. 169, 176 (App. Div. 2012). The law provides that
while “the custodian is obligated to search [his] files to find the
identifiable government records listed in the Complainant’s OPRA request…
the Custodian is not required to research [his] files to figure out which
records, if any, might be responsive to a broad or unclear OPRA request.”
Burnett v. County of Gloucester, 415 N.J. Super. 506, 515 (App. Div.
2010), quoting Donato v. Township of Union, GRC 2005-182, interim order
(January 31, 2007). Your request is overly broad as it does not request
specific identifiable records. See MAG Entertainment, LLC v. ABC, 375 N.J.
Super. 534, 546-48 (App. Div. 2005). Please see attachment.
 
 If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the Clark Police Department to deny
access. At your option, you may either institute a proceeding in the
Superior Court of New Jersey or file a complaint with the Government
Records Council (GRC) by completing the Denial of Access Complaint Form.
