Good morning,
Attached please find the response to your OPRA request. Please be advised
that pursuant to N.J.S.A. 47:1A-1.1, the CAD report has been redacted to
protect the disclosure of personal identifying information, including
driver license numbers, street addresses, month and date of birth,
unlisted phone numbers, and persons not involved. See also Serrano v.
South Brunswick Twp., 358 N.J. Super. 352, 368-69 (App. Div. 2003).
Please be further advised that the Incident Report is an exempt criminal
investigatory record. Specifically, incident reports are protected from
disclosure pursuant to N. Jersey Media Grp., Inc. v. Twp. of Lyndhurst,
229 N.J. 541 (2017) (the CIR exception applies when the incident pertains
to an investigation into “actual or potential violations of criminal
law”. Id. at 569 and Paff v. Ocean Cty. Prosecutor’s Office, 235 N.J. 1
(2018). Finally, please be advised that a booking photo or mug shot is
exempt from disclosure pursuant to Executive Order No. 69 (Whitman 1997)
and EO 21 (McGreevey 2002)) which exempts fingerprint cards, plates and
photographs and similar criminal investigation records that are required
to be made, maintained or kept by any State or local governmental agency.
