The Township of Fairfield (the “Township”) is in receipt of
your request under the Freedom of Information Act . New
Jersey municipalities are not subject to the federal Freedom
of Information Act, 5 U.S.C. § 552, et seq. Rather, access to
government records may be requested under the New Jersey Open
Public Records Act, N.J.S.A. 47:1A-1, et seq (“OPRA”). Under
OPRA, requestors are required to certify as to the following
three (3) matters: (1) whether the requestor has not been
convicted of any indictable offense; (2) whether the
requestor or any other person will use the requested records
for a commercial purpose; and (3) whether the requested
records are sought in connection with a legal proceeding.
In order to facilitate the efficient processing of your
request, we urge you to use the Township’s OPRA portal

the required certifications not be received within seven (7)
business days, the Township will close your requests without
further notice.

Record request #25-179 has been closed. The closure reason
supplied was:
Please be advised that your request is denied as it seeks
information as opposed to government records. A request for
“information” as opposed to identifiable government records
is invalid under OPRA. See, e.g., James v. NJ Dep’t of
Corrections, GRC Complaint No. 2009-283 (June
2010). Furthermore, the New Jersey Superior Court has held
that "[w]hile OPRA provides an alternative means of access to
government documents not otherwise exempted from its reach,
it is not intended as a research tool litigants may use to
force government officials to identify and siphon useful
information. Rather, OPRA simply operates to make
identifiable government records ‘readily accessible for
inspection, copying, or examination.’ N.J.S.A. 47:1A-1." MAG

375 N.J. Super. 534, 546 (App. Div. 2005).
