Dear Rowan University,

I am writing to request access to and copies of records under the New Jersey Freedom of Information Act.
Specifically, I am seeking information related to:

Rowan is receipt of your April 29, 2025, request under the "New Jersey Freedom of Information Act", please be advised that the Open Public Records Act (“OPRA”) law governs New Jersey public institutions, like Rowan University, release of documents to the public. The Freedom of Information Act ("FOIA") governs federal agencies, like the Federal Bureau of Investigation (FBI) and Immigration and Customs Enforcement (ICE).

Please accept this as Rowan’s completed response to your request wherein you sought the Arrest report, Incident report and Mug Shot related to #2023-037207.

Reports related to crimes are exempt from disclosure to the public under OPRA's criminal investigation exemption. N.J.S.A. 47:1A-1.1(5) and N. Jersey Media Grp., Inc. v. Twp of Lyndhurst, 229 NJ 541 (2017). As such, your requests for the arrest and incident reports are denied.

Your request for the mug shot is denied pursuant to Melton vs. City of Camden, 2011-233 (2013) and OPRA EO 69 (Whitman) which specifically exempt mug shots from disclosure to the public.

You have the right to challenge this decision by Rowan University. You can file a Complaint in the Superior Court of New Jersey or complete a Denial of Access Complaint Form with the Government Records Council (GRC).
