The new OPRA form and Assembly Bill are attached for your perusal and use.
As of September 3, 2024 OPRA in New Jersey has been reformed. Please see attached updated OPRA request form and Legislature. This new form is required by law to be filled out completely in order to be considered a valid OPRA request.
Please review the legislation completely and take note on sections regarding requests for “commercial purposes.” There are fines involved with violations (page 26 Line 1).
“Commercial purpose” means the direct or indirect use of any part of a government record for sale, resale, solicitation, rent, or lease of a service, or any use by which the user expects a profit either through commission, salary, or fee. “Commercial purpose” shall not include using, distributing, gathering, procuring, transmitting, compiling, editing, disseminating, or publishing of information or data the use of a government record for any purpose by…” Page 3 Line 13.
“All requests by a data broker or a requestor who is making a request on behalf of and for the use of a data broker shall be denied. The form also shall include space for a requestor to certify that the requestor is not a data broker or is not making the request on behalf of or for the use of a data broker, and the requestor shall be required to provide this information for the request to be fulfilled. Data obtained through a records request shall not be sold…” Page 16 Line 3.
Addition of question regarding whether the requested records are
sought in connection with litigation (must identify proceeding).
