various documents related to the August 18, 2018,  arrest of Alex Guzman. 
Please be advised that under OPRA we  are denying this request because you
currently have an identical  OPRA request  filed in our office that is
still open.  You cannot have two identical requests open at the
same time.  
You state in this current request that your first request was mailed on
September 2, 2024.  Please be advised that your first request was received
in our office on September 6, 2024.  Our office has 7 business days to
respond to your OPRA request from the date of receipt.  Our office has
also been in contact with you to request an extension on the original
request until September 26, 2024 to which you agreed.   Therefore, this
OPRA will be denied and your response will be given under your original
OPRA request #278

Dear East Rutherford Borough,

Please accept this electronic request for public records made under OPRA
and the common law right of access.  I am not required to fill out an
official form or use a particular software platform to submit my request
per NJSA 47:1A-6(f), which states that an email from a requestor including
all of the information required on the adopted form shall suffice in place
of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New
Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Good afternoon. I hope you can help me. This is my second request. I 
mailed my first request on September 2nd, 2024, and have not received a
reply to my email as requested as I am disabled.  I am requesting all
police reports, arrest reports, photographs, booking/arrest photos,
complaints, DWI results, and body worn camera footage for the arrest of
Alex J. Guzman for a DWI arrest on or about August 18, 2018 near Paterson
Ave and Hachensack Street. Mr. Guzman was 39 at the time of the arrest and
a Carlstadt resident. I believe this matter is no longer an active
criminal investigation and was adjudicated in court years ago.

My preferred delivery method for response(s) to this request is by E-mail
as attachments.  Please confirm you have received this request.  If you
are not the custodian of records, please forward my request to that person
and provide their email address to me for future reference.
