Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

A. Certification record

1. COAH's First Round substantive certification for Clark Township, granted
September 4, 1991, together with the certified Housing Element and Fair
Share Plan and the resolution granting certification (including the vacant
land adjustment establishing a Realistic Development Potential of 23 units
and the four inclusionary sites zoned for 42 affordable units).
2. Clark's second/third-round petition file: the plan filed September 4,
1997; the resolution of petition received August 23, 1999; COAH's
March 28, 2000 report requesting additional information; the amended
plans adopted February 12, 2001, December 11, 2001, and August 24, 2004;
the re-petitions of March 1, 2001, December 17, 2001, and September 13,
2004; and any COAH resolution or report acting on them (including the
mediation record with Clark Developers concerning Block 58, Lot 4).

B. Monitoring — what was actually built

3. All annual monitoring reports submitted by or for Clark Township to
COAH (including CTM/Monitoring submissions), for all years held —
in particular any report identifying affordable units constructed,
granted certificates of occupancy, or credited in Clark between 1987 and
COAH's dissolution.
4. Any COAH credit determinations for Clark, including credits granted for
the ARC of Union County group homes (1985, 1995, 2000).

C. Trust fund

5. Clark Township's development fee / Affordable Housing Trust Fund
records held in the COAH file: approved development fee ordinances,
approved spending plans, and annual trust fund monitoring submissions, for
all years held.

I am requesting the identifiable contents of one municipality's archived file,
not a research service. If the file is voluminous, I welcome phased
production beginning with item 3 (monitoring reports), which is the priority.
If records for some years were not retained, please say so rather than deny
the request; if any record is claimed exempt, please identify it and the
exemption with specificity and produce the remainder.
