Hello, we have been informed by a different public authority that we can narrow this request by "limiting the timeframe from three months to a specific 2 to 3-day period" (~Governmental Relations Specialist NJ Department of Health).

Accordingly, we would like to revise our request as follows:

incident detail reports, operations reports, investigation reports, arrest reports referencing incidents starting April 24, 2015 at 4PM and ending April 27, 2015 and 9am.

This adjustment reduces the scope to a period of less than 72 hours and as such, within reason.

I am writing to request an internal review of Paramus Borough Police Department's handling of my OPRA request 'April 2015 policereports'.

In an effort to further narrow the scope of this request, the timeframe has been limited to the period beginning April 24, 2015 at 4:00 PM and ending April 27, 2015 at 9:00 AM.

The request is therefore limited to records generated during that specific period, including incident detail reports, operations reports, investigation reports, and arrest reports referencing incidents occurring within that window.

This revision reduces the scope of the request to less than 72 hours and is intended to reasonably assist in identifying responsive records.

Further narrowing the request by identifying a precise incident date, time, or other uniquely identifying facts would effectively defeat the anonymity expressly permitted under New Jersey law, as doing so could readily reveal the identity of the requester and/or the specific matter being inquired into.

The request has already been substantially narrowed in both timeframe and record category. Providing additional uniquely identifying details would undermine the anonymity permitted under New Jersey law and is therefore respectfully declined.

Thank you for the production of records responsive to the revised request covering the period beginning April 24, 2015 at 4:00 PM and ending April 27, 2015 at 9:00 AM.

After reviewing the materials provided, several apparent inconsistencies in the production and withholding rationale require clarification.

The cover letter states that certain records were withheld on the basis of medical privacy. However, the production also included numerous reports involving sick or injured persons, as well as incidents involving juveniles where identifying information appears to have been redacted rather than the reports being withheld in full. As such, it is unclear what distinction was applied in determining which responsive records were released with redactions versus withheld entirely.

The response indicates that approximately twenty responsive records were withheld, at least in part, on the basis of medical privacy and related concerns. However, the production also included numerous reports involving sick or injured persons, medical calls, transports, and incidents involving juveniles, with identifying information apparently redacted where appropriate.

Accordingly, it is unclear what distinction was applied in determining which responsive records could be produced with redactions versus withheld entirely.

Additionally, the request specifically sought investigation reports generated during the relevant period. Despite the substantial number of incidents occurring within the requested timeframe, the production appears to contain only a single investigative report.

Given the volume of records produced and the apparent use of redaction protocols elsewhere in the response, clarification is respectfully requested regarding:

1. Whether additional responsive investigation reports exist but were withheld in full;
2. Whether responsive records were withheld in their entirety where redaction may otherwise have been possible;
3. The specific exemption(s) relied upon for any full withholding of responsive records; and
4. Whether a privilege log, withholding index, or similar accounting of withheld responsive records can be provided.

This request is made solely to better understand the methodology used in the response and the basis for the distinctions applied among responsive records.

This correspondence is intended as a limited follow-up regarding the records production responsive to the revised OPRA request covering the period beginning April 24, 2015 at 4:00 PM and ending April 27, 2015 at 9:00 AM.

Please note that the previously requested internal review remains pending and is not withdrawn by this correspondence.

The cover letter accompanying the production referenced investigative materials/reports as being included in the response. However, upon review of the files provided, it appears that either:

1. the investigative report attachment was not included;
2. the file did not properly upload/transmit; or
3. the file may be inaccessible or corrupted.

At present, only a single investigative report appears accessible despite the cover letter indicating investigative materials were part of the production.

Accordingly, please confirm whether any investigative-report attachment was inadvertently omitted from the production and, if so, please re-transmit the responsive file(s).

Thank you for retransmitting the investigative materials referenced in the prior production.

After reviewing the newly provided files alongside the previously released CAD/incident detail records, clarification is still requested regarding certain apparent gaps in the production.

The production appears to contain in excess of 275 CAD/incident detail records generated during the requested timeframe. While it is understood that not every CAD entry necessarily results in a corresponding investigative or operations report, the number of investigative materials produced appears comparatively limited, and no operations reports appear to have been included in the response.

Additionally, several released CAD/incident records appear to reference:
- detective bureau involvement,
- assigned DB/investigation numbers,
- arrests,
- witness statements, and/or
- follow-up investigative activity.

However, for certain incidents where those references appear within the released CAD materials, corresponding investigative reports and/or arrest reports do not appear to have been included in the production.

This is particularly notable given that the overall production otherwise included numerous redacted records involving juveniles, medical calls, transports, arrests, and other sensitive matters, indicating that at least some responsive records were capable of being produced in redacted form rather than withheld entirely.

Accordingly, please clarify:

1. Whether additional responsive investigative or operations reports exist for incidents already identified within the released CAD materials;
2. Whether additional responsive arrest reports exist for incidents already identified within the released CAD materials;
3. Whether any such responsive reports were withheld in full;
4. Whether any responsive records remain pending production; and
5. The specific exemption(s), if any, relied upon for withholding responsive investigative, operations, or arrest-related records associated with already-produced CAD incidents.

Please note that the previously requested internal review remains pending and is not withdrawn by this correspondence.
