Dear Spotswood Borough,

Please accept this electronic request for public records made under the OPRA and the common law right of access. I am a journalist with New Brunswick Today and Trenton Makes News, and require the records for my reporting on New Jersey's local governments, school districts, and autonomous authorities. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Please provide a copy of your current directory of appointed officials, as of today, 10/1/2024, including at least the following information for every authority, board and commission:
(a) the name of the authority, board, or commission;
(b) the number of members or positions;
(c) a list of currently appointed members, along with their terms of office;
(d) vacancies;
(e) general frequency of meetings; and
(f) the appointing authority and the enabling statute, ordinance, or resolution, if any.

My preferred delivery method for response(s) to this request is by E-mail as an attachment.

If no current directory exists, or if the directory is missing some of the above information, be guided by NJSA 40A:9-9.2, which requires the above directory to be maintained on an ongoing basis and to include, at a minimum, the information that I am presently requesting.

We are in receipt of your OPRA request. On June 5, Governor Murphy signed
Senate Bill 2930 into law, which significantly amends New Jersey’s Open
Public Records Act (OPRA) with an effective date of September 3, 2024.
Please be advised that due to the new changes to the law regarding the
disclosure of government records, the Clerk’s Office may require
additional time to ensure compliance with the new provisions. 

 

Please be further advised that the Borough has been inundated with OPRA
request which will require the Borough additional time to respond to your
request. Indeed, the sheer number of requests have caused a substantial
disruption to the operations of the Borough Clerk. We would request
patience as the Borough reviews and responds to all outstanding requests
which predate the receipt of your request.  The Borough will require at
least another 30 days to respond. If we are able to respond earlier, you
will be advised.

Dear Ms. Servis,

This is not acceptable, and I cannot authorize a 30-day extension of time for this request. My request was filed October 1, and the Borough failed to respond timely as required by the OPRA. I requested a single record which your office is required by law to maintain on an ongoing basis.

Why can't you simply send my a copy of this record via email and close out this request? Are you maintaining the directory of officials as required by NJSA 40A:9-9.2?

Dear Ms. Servis,

My request is NOT complete. This is not the record that I requested. Further, I don't understand why it took almost one month for you to send this record to me. Please review the law that I cited in my request.

For clarification, most municipalities have one or more land use boards (i.e. Planning Board, Zoning Board, etc.). I can tell from your website that Spotswood also has a Recreation Committee and a Cultural and Heritage Commission. You are required by law to maintain a directory of the officials who occupy the seats on those bodies. On October 1, I requested a copy of the directory. Do you maintain such a directory? If so, provide a copy to me immediately. If not, you will need to create one in order to comply with with law.

As stated in my original request, the information that must be included in the directory for each body is as follows:
(a) the name of the authority, board, or commission;
(b) the number of members or positions;
(c) a list of currently appointed members, along with their terms of office;
(d) vacancies;
(e) general frequency of meetings; and
(f) the appointing authority and the enabling statute, ordinance, or resolution, if any.

Please provide a response promptly and advise if the directory exists.
