I am writing to request an internal review of Dover Township's handling of my OPRA request.
You have yet to supply us with the requested information. Please indicate whether or not you will be supplying us with the information we requested... resume, background check, personnel files, pre employment screenings... ect. We will be filing a denial of request complaint on Friday if you do not provide us with the information we requested nearly one month ago. Our Denial Complaint will be copied to the Michael Patrick Carroll and the rest of the Legislative District's legislators along with anyone else we can think of that would be interested in Dover Township not supplying public records to the public.

Thank you for your email. It is surprising to me that you are threatening litigation, as I firmly believe that the Town fully responded to your OPRA request. In that regard, I previously sent you all the responsive Government Documents that are in the possession of Town. Following a diligent search, I concluded that we are not in possession of a resume for Mr. Brown.
As to the remainder of Mr. Brown's personnel file (i.e. the application, background checks), it is my understanding that personnel records, to the extent that any exist, are not considered government records for disclosure under OPRA. Specifically, N.J.S.A. 47:1A-10 provides, in relevant part, that the Town may only disclose an individual’s name, title, position, salary, payroll record, length of service, date of separation and the reason for such separation, and the amount and type of any pension received. In addition, I have attached the Final Decision in Parreott v. Asbury Park for your review which I believe is instructive on this matter.
I hope that the foregoing along with the attached resolves the issue; however, I am more than happy to discuss these issues with you at any time.
