Ms. Discenza,

The Department of Education does not make or maintain records responsive
to your request for email logs regarding the subject “Shawn Giordano” for
the time period provided in your request.  Accordingly, that part of your
request is denied. 

Regarding the part of your request seeking email logs for any non-student
related emails, a preliminary search using the parameters you identified
in your request yielded over 4,900 emails. In order to fulfill your
request, the OPRA custodian would be required to conduct a review of these
email headers for any privileged material that needed to be redacted or
withheld and conduct a review for any other redactions appropriate under
the law, such as redactions of personally identifiable information. Please
note, is not limited by content because I cannot conduct that type of
search without a keyword.

Such a review would be unduly burdensome and substantially disruptive to
the DOE’s operations.  Accordingly, we request that you modify the scope
of the second part of your request.  Otherwise, this part of your request
will be denied pursuant to N.J.S.A. 47:1A-5(g), which provides, in
pertinent part, “If a request for access to a government record would
substantially disrupt agency operations, the custodian may deny access to
the record after attempting to reach a reasonable solution with the
requestor that accommodates the interests of the requestor and the
agency.”
