Dear North Wildwood City,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

I request copies of the following records concerning Andrew Moon, Tyler Huck, and Ryan Ladd v. City of North Wildwood, et al., Docket No. CPM-L-443-22:

1. The final, fully executed settlement agreement, release, or other agreement resolving any claims between the plaintiffs and the City of North Wildwood and/or its officers, employees, agents, or insurers.

2. Any final resolution, ordinance, consent-agenda item, meeting minutes, or other final governmental action approving or authorizing the settlement.

3. Records reflecting the total amount paid pursuant to the settlement, including payment vouchers, checks, electronic-payment records, or other records sufficient to identify the amount and date of each payment.

4. Records identifying whether settlement payments were made directly by the City, an insurance carrier, joint insurance fund, or another entity on the City’s behalf, and records sufficient to identify the amount paid by each entity.

5. Any final court-filed stipulation of dismissal, consent order, or other final document reflecting resolution of the claims against the City or its officials.

For clarity, I am not requesting drafts, attorney-client communications, settlement negotiations, litigation strategy, or other predecisional deliberative communications. This request seeks final and executed records documenting the disposition and expenditure of public or publicly insured funds.
