Dear Monmouth County Prosecutor's Office,
I'm writing to follow up on an OPRA request in regards to Andre Parker. It was submitted on 6-19-2020
Yours faithfully,
ASK NJ Media Co.
The below OPRA request was one of the 26 open requests of yours for which the response deadline was extended to July 17, 2020 by correspondence to you dated June 25, 2020.
There are two files for Andre Parker. One is an open 2017 file. I have obtained those records for redaction and transmission to you.
The other file is a closed 2013 file. Those records are unavailable electronically and, to date, we have been unable to locate our paper file.
Your request was for "copies of any mug shot(s), criminal charge complaint(s)," etc. with respect to Andre Parker. It did not provide a case number to specify whether the request was for the open 2017 case only, the closed 2013 case, or both.
If you would like to clarify the request as for only the 2017 case records, then I can satisfy the request with the records that I have obtained.
If you choose not to clarify in this manner, you will receive a response by our extended deadline of July 17, 2020. If the 2013 file is found between now and then, you will have the publicly-accessible records from it; if the file is not found, we will either seek an additional extension -- or, if search efforts are exhausted and the file is deemed "lost," the records request will be denied on that ground.
Dear Mary Juliano,
I'm looking for the open file from 2017 at this point.
Yours sincerely,
ASK NJ Media Co.
Thank you for the clarification.
Attached please find responsive records. Driver's license, social security, and phone numbers are redacted pursuant to N.J.S.A. 47:1A-5.
Request for final disposition is denied for lack of a responsive record. Mug shots is exempt from disclosure pursuant to N.J.S.A. 47:1A-9 and Executive Orders 9(e) (Hughes), 69 (Whitman), and 21 (McGreevey), which apply to "Fingerprint cards, plates and photographs and other similar criminal investigation records which are required to be made, maintained or kept by any State or local governmental agency."
Dear Mary Juliano,
Thank you for your response. This confirms my receipt of the records and I consider this request fulfilled.
Yours sincerely,
ASK NJ Media Co.
