Dear Seaside Heights Borough,
This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.

I am requesting copies of any and all police reports or documents related to any Seaside Heights Police Department activity on and after 07-January-2024 until and including 31-January-2024.

The Township received your OPRA request seeking: “any and all police
reports or documents related to any Seaside Heights Police Department
activity on and after 07-January-2024 until and including
31-January-2024."
Your request is overly broad and requires clarification, it fails to
specify a particular document as required under OPRA. An OPRA requestor
is required to specifically describe the document sought, OPRA is not
intended as a research tool to “force government officials to identify and
siphon useful information. Rather, OPRA simply operates to make
identifiable government records ‘readily accessible for inspection,
copying, or examination.’ MAG Entertainment, LLC v. Division of Alcoholic
Beverage Control, 375 N.J. Super. 534, 546 (App. Div. 2005).
OPRA is not intended to be used as a fishing expedition or as a research
tool to compile unknown documents. You have requested all police documents
for a specified time frame. Please clarify your request specifying
specific documents/incidents. A failure to provide written clarification
will result in the denial of the request.

Please accept this correspondence on behalf of the Borough of Seaside
Heights in response to your OPRA request dated April 9, 2024 seeking “all
police reports filed by Seaside Heights Police Department on and after
07-January-2024 until and including 31-January-2024.” . “All police
reports” is not a specific document. The Borough has responded twice in
writing requesting clarification on April 9, 2024 and again on April 15,
2024, however you have failed to clarify or narrow your request.
Your request fails to identify with clarify the specific government
records sought and as such it is denied on the basis that it is overly
broad.
