Regarding your OPRA request for the following - " I seek all open lawsuits
by citation for the Nutley Board of Education and all lawsuits closed in
the past 12 months. I seek any and all lawsuits where the Nutley Board of
Education was named as a Plaintiff, Defendant Third party or a witness.I
see the citations only.”
I respond as follows.
Under OPRA, agencies are required to disclose only “identifiable”
governmental records not otherwise exempt; wholesale requests for general
information, to be analyzed, collated, and compiled by the responding
government entity, are not encompassed by OPRA. In addition,
the Custodian of Records is not required to research files to figure out
which records, if any, might be responsive. OPRA does not require the
Custodian of Records to create documents
in response to requests. Accordingly, your request is denied.
