Dear Milltown Borough,
Please pass this on to the person who conducts Open Public Records Act reviews.
I am writing to request an internal review of Milltown Borough's handling of my OPRA request 'All Interactions with Marc Jellinek from 1 Jan 2023 through 1 Nov 2023'.
I am concerned about the lack of response to this legal OPRA request. Please expedite the satisfaction of this request.
A full history of my OPRA request and all correspondence is available on the Internet at this address: https://opramachine.com/request/all_inte...
Yours faithfully,
Marc Jellinek
Mr. Jellinek:
Please explain your specific concerns. We spoke by phone and you told me that you would be stopping by last week to get the DVD of the requested body cam footage instead of giving me your address. I also explained that if there was any further footage you wanted, you would have to submit another OPRA request. These DVDs are still sitting in my office waiting for you. I called you twice to follow up but there was no answer and I was unable to leave a voicemail. am unclear as to what issue you are complaining about and would like reviewed. You can respond here via OPRA machine or call me in my office at the number below. Thank you.
Kind regards,

Dear Monica Orlando,
My concerns are:
1. I do not have the ability to forego my responsibilities and rearrange my schedule based on your personal availability.
2. The OPRA request was not satisfied within the term set by the law.
3. I do not have access to a CD ROM drive to consume the information. I have been attempting to procure one, but they are so out of date that no one has them in stock.
4. OPRA defines your responsibilities. Those responsibilities have not been satisfied under the letter of the law.
As a courtesy, I will swing by to pick up the information in a manner I am able to consume within the limits of the law.
Yours sincerely,
Marc Jellinek
Good afternoon Mr. Jellinek:
1. I offered to send this via postal mail. You are the one who requested to pick up the CDs. You advised me it was "a nice day for a drive to Milltown". My offer to send these via postal mail still stands if you would like to call my office or email me directly [Milltown Borough request email] with your address.
2. I disagree. The items requested in your OPRA were sent, and I offered to mail the items that were put on CD. Anything outside of what you specifically requested will have to come to me as another OPRA request.
3. If you had requested a different media, such as USB drive, I could attempt to do that for you. When we spoke by phone you did not make any request for this, nor did you state you do not have access to view the CDROM.
4. I understand my responsibilities and stand by the statement that I fulfilled your request, subject to you giving me the information I requested to send you the CD.
5. Again, I have offered to mail these items. If you prefer a USB stick, please let me know. I do not expect you to "pick up the information in a manner" you are "able to consume within the limites of the law". Again, this can be sent via postal mail which is well within one of the options for an OPRA response.
I await your response. Please note that Borough offices are closed in observance of Veteran's Day tomorrow, 11/10. I will return on Monday, 11/13. Have a great weekend.
Kind regards,

Dear Monica Orlando,
You have not completely satisfied my request. The materials provided are incomplete. They do not include my interactions with the front desk, they do not include interactions the officers had using their personal mobile phones and does not include all interactions between myself and officers and other personnel at Milltown Borough Hall.
Please include my most recent interactions, including new IA investigation requests.
It is my intention to forward this interaction to the Middlesex County Prosecutors Office, the Superior Court, the NJ Government Records Council for their review.
Yours sincerely,
Marc Jellinek
I have forwarded your list to the Police Department of video footage you say are missing. I will update you on the response.
