I am in receipt of your request for the following:
“I am requesting all communications from 1/2019 to 6/2022 from neighbors regarding 4101 Bridgeboro road between neighbors and township officials. Please include all attachments and the scope of this includes not only elected officials it appointed such as zoning and police”
Currently, your request fails to identify with reasonable clarity the specific government records sought. As written the request for communications from “neighbors”, is unclear and overly-broad because the term could be defined and interpreted to mean those persons/properties adjacent to 4101 Bridgeboro Road or those simply located nearby. At this time, we request clarification of your OPRA request.
Generally, requests for communications must identify senders and recipients of the messages, the subject matter, and must also include a time frame or dates from which the correspondences were sent. See Elcavage v. West Milford Twp. (Passaic), GRC Complaint No. 2009-07 (April 2010). At a minimum, a request must be specific enough that a custodian is not required to “exercise subjective judgment in determining which records must be produced.” Simmons v. Mercado, 247 N.J. 24, 43 (2021). Please respond in writing and identify the specific government records sought including the sender and recipient of the communications so that we may process your request. To that end, provide us with the names or email addresses of neighbors (or a limited group thereof that can be searched) and the names and/or titles of the Township officials whose records you seek. You may also clarify your Request in a manner that you deem appropriate so long as it identifies with reasonable clarity the records sought. Failure to provide written clarification of your request will result in the closure of this OPRA request.
Please feel free to reach out with any additional questions.
