In Elcavage v. West Milford Twp., GRC Complaint No. 2009-07 and 2009-08 (April 2010), the GRC determined that in accordance with legal precedent: “[I]n order to specifically identify an e-mail the OPRA request must contain (1) the content and/or subject of the e-mail, (2) the specific date or range of dates during which the e-mail was transmitted or the e-mails were transmitted, and (3) identification of the sender and/or the recipient thereof.” Your request for “reopening” does not articulate a specific subject or content. Accordingly, please clarify your request and provide a subject or content so that the District may conduct a search for identifiable government records.

The District has identified 319 pages of records responsive to your request. Please note that redactions have been made throughout the records to remove personal email addresses and personal telephone numbers pursuant to N.J.S.A. 47:1A-1 (providing that “a public agency has a responsibility and an obligation to safeguard from public access a citizen’s personal information with which it has been entrusted when disclosure thereof would violate the citizen’s reasonable expectation of privacy,”); see also N.J.S.A. 47:1A-1.1 (exempting that portion of any document containing an “unlisted telephone number” from the definition of a “government record”).
Additionally, please note that N.J.S.A. § 47:1A-9.a allows exemptions from disclosure made pursuant to Executive Order of the Governor. N.J.S.A. § 47:1A-9.b allows exemptions from disclosure for any grant of confidentiality established or recognized by the Constitution of this State, statute, court rule or judicial case law, to apply to OPRA. Executive Order No. 26 (McGreevey 2002) exempts from disclosure “information relating to medical, psychiatric or psychological history, diagnosis treatment or evaluation.” As such, RIDGEWOOD BOE OPRA 45-47 and 304-306 have been withheld as they contain information relating to medical history, diagnosis, treatment, and/or evaluation.
Lastly, please be advised that RIDGEWOOD BOE OPRA 48 and 258 (email correspondence from Thomas Gorman to District Administrators dated May 4, 2021 regarding Students Returning to School) reflect “intra-agency advisory, consultative, or deliberative material” pursuant to N.J.S.A. 47:1A-1.1, and thus are shielded from public access accordingly.
