64 Forrest St - Landlord Registration Form

Michael Weiss made this OPRA request to Metuchen Borough Automatic anti-spam measures are in place for this older request. Please let us know if a further response is expected or if you are having trouble responding.

Metuchen Borough did not have the information requested.

Dear Metuchen Borough,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

The landlord registration form for 64 Forrest St

An example can be found on the borough's website: https://metuchennj.org/government/forms/...

My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Yours faithfully,

Michael Weiss

Dear Metuchen Borough,

This request is still open and I am requesting it be fulfilled.

Last week a gentleman who only identified him as "Metuchen fire department" called me on the phone asking me what information I was looking for exactly, to which I responded that I'm looking for the rental registration for the address 64 forrest st. He stated he doesn't have the form handy, and asked again what exactly I was looking for. I reminded him that the form is available on the boroughs website and that I'm requesting all information listed on that form. He then became irritated and asked me several times if I "Know who I pay my rent to". I informed him I did know who I pay rent to and that I was not required to answer questions or explain why I'm request the record. He then hung up on me.

I request that the borough either provide me with the record or inform me if the record has been lost or does not exist. I've been attempting to get the rental registration for this property for over 2 months now. I believe its a simple request and doesn't warrant any further delay.

Regards,
Mike

Good afternoon Mike,

I'm sorry you had that experience with our fire inspector. I had referred the request to them because they are the agency that handle landlord registration.

Fire has told me the record was on file at one point but no longer exists. Again, I apologize that your request was not handled professionally and that a reply took longer than needed.

Dear Deborah Zupan,

Thank you for you response Deborah. I'd like to remind the borough that they are required under state law and local ordinance to maintain these records and provide access upon request. In this instance it appears the borough is happily collecting annual registration fees but does not actually have the proper registration. I politely request the borough look into this matter as these records are required for fire safety and other reasons.

I will close this request as "record not available" I hope that is indeed accurate statement.

Yours sincerely,

Michael Weiss
