Dear North Bergen Township,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

Dear Mr. Hank:

The Township writes in response to your 5/30/2025 request for records pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq. (“OPRA”).

You requested:

“I am requesting all video surveillance footage from the exterior of 5930 Tonnelle Ave. The footage requested should include all parking lots in front of, behind, and adjacent to this location. The dates and times being requested are Thursday May 22, 2025 at 5pm to Friday May 23, 2025 at 5pm. Thank you.”

OPRA allows public agencies to impose special service charges whenever the nature, format, manner of collation, or volume of a government record is such that fulfilling a request requires an extraordinary expenditure of time and effort. See N.J.S.A. 47:1A-5.c.

The Township has in excess of 144 hours of surveillance footage responsive to your request from various cameras. The Township estimates that it would take approximately 12 hours to review, redact where necessary in accordance with OPRA, and produce the requested records. Accordingly, the Township will require a deposit of $100.00 toward the total of $282.24 (12 hours x $23.52/hr [the lowest hourly rate of an employee capable of performing the review/production]) before the review begins. The entire sum will be due prior to the records being produced. If the review is completed in less time than estimated, any unused portion of the deposit will be returned to you. If the review takes longer than 12 hours, the Township will stop work and require a further deposit based on the additional amount of time estimated to complete the review.

Kindly respond in writing with your acceptance or rejection of this estimated charge. The Township will not begin to process your OPRA request until we receive your written acceptance.

If you reject the estimated special service charge, you have a right to challenge the decision. At your option, you may either institute a proceeding in the Superior Court of New Jersey or file a complaint with the Government Records Council (GRC) by completing the Denial of Access Complaint Form. You may contact the GRC by toll-free telephone at 866-850-0511, by mail at P.O. Box 819, Trenton, NJ, 08625, by e-mail at [email address], or at their web site at www.state.nj.us/grc. The GRC can also answer other questions about the law. All questions regarding complaints filed in Superior Court should be directed to the Court Clerk.
