Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.

Original building permit records
Zoning records indicating permitted use or number of dwelling units
Any zoning approvals, variances, or planning board resolutions
Property record cards or zoning determination letters identifying the legal number of units
Please include any documents confirming whether the property is legally recognized as a single-family, two-family, or multi-family dwelling.
Records of past or present underground oil tank

Commercial Purpose (exception)
Effective September 3, 2024: If the requestor is seeking records for a “commercial purpose” as
defined in N.J.S.A. 47:1A-1.1, where the response time frame is fourteen (14) business days,
but the custodian shall notify the requestor of the additional time within seven (7) business
days. N.J.S.A. 47:1A-5(i).
Daniel’s Law (exception)
Effective September 3, 2024: If the requestor is seeking records requiring review for
compliance with “Daniel’s Law” (N.J.S.A. 47:1B-1, et seq.), where the response time frame is
fourteen (14) business days, but the custodian shall notify the requestor of the additional
time within seven (7) business days. N.J.S.A. 47:1A-5(i).
As an exception to the typical response time frame, P.L. 2020, c.10, enacted on March 20,
2020, N.J.S.A. 47:1A-5(i) provides that the statutory time frame shall not apply during a
state of emergency, public health emergency, or state of local disaster emergency.

Zoning: the property is a legal nonconforming three family
house in an R-2 Two Family Zone. The property has not been
involved in a prior zoning variance application. While there
are no open violations of the Montclair zoning ordinance on
record, the property is apparently lacking the proper NJ DCA
multiple dwelling inspection and also lacking certain
required housing inspections done by the Montclair Code
Enforcement Dept (habitability, lead paint, rent control,
etc.). The Code Enforcement Dept should be contacted at (973)
509-5703.
