Dear Mr. Kratovil:  You have objected to my response to your OPRA request
seeking "complete copies" of all petitions filed with my office by
candidates for County Committee in the June 4th primary election.  You
object because I redacted from the documents I supplied you the unlisted
telephone numbers next to the candidates' names, ground addresses and
email addresses.  I believe these to be unlisted numbers because they do
not reflect a Pennington exchange.    
I am relying on the Open Public Records Act which provides at NJSA
47:1A-1.1 that a "government record" for purposes of the statute shall not
include, among other things, the "portion of any document which discloses
the social security number, credit card number, unlisted telephone
number or driver license number of any person." and that such information
is deemed confidential for OPRA purposes.  
You rely on NJSA 19:13-9 which provides that all candidate petitions "when
filed shall be open under proper regulation for public inspection."       
I have conferred with the Borough Attorney who advises that redaction of
the unlisted telephone numbers under the quoted OPRA provision is not
inconsistent with the requirements of NJSA 19:13-9 which provides for
public inspection of the petitions  subject to "proper regulation."

How did you determine whether the phone numbers were listed or unlisted? I don't agree with your office's assessment of the law, but I will respectfully ask that you justify your own logic by indicating what method you used to determine these phone numbers are unlisted.

Please see my e-mail of 4/12/2024.  The determination that the numbers are
unlisted is based on the fact that they do not have a Pennington Exchange
and are obviously cell phone and cell phone numbers are not listed
numbers.   I went a step further and searched each number on the white
pages reverse phone lookup and one came up as registered to one of the
County Committee candidates.    I have attached a non-redacted copy of the
County Committee Petition filed for Daniel Pace as his number did come up
as listed.
