Dear Pompton Lakes Borough,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

2024 police payroll records for January 1, 2024 to December 31, 2024, including the categories and line items below:

1. Total earnings for each full-time police officer

2. Compensatory time earned by each full-time police officer

3. Overtime earned by each full-time police officer

4. Extra Duty Pay earned by each full-time police officer

5. Shift commander duty pay for each full-time police officer to include any special pay for officers of all ranks for out of job title adjustments.

6. Health benefit waiver

7. Any other compensation to the police officer not named above

The responsive documentation requires redaction before it can be released
which requires an “extraordinary expenditure of time and effort.

 

Based on our review the request will require approximately 2 hours of the
Police Departments administrative assistant’s time at an hourly rate of
$31.38 resulting in a total estimated cost of $62.76.

 

In accordance with OPRA the Borough requires a 50% payment in advance
before work will begin, with the remaining balance due prior to release of
the responsive records.

I am surprised to hear this as 2022 and 2023 police payroll records were released via OPRA without any charges, so I’m not sure why 2024 would cost money to be made accessible to the public.

I will take a modified OPRA reply of 2024 gross salary/pay and OT totals broken down by police officer name.

In response to your inquiry. The 2022 and 2023 police payroll records have already been redacted for a previous OPRA request. The current requester would still be responsible for standard copying costs for physical documents or for the actual cost of media like a disc.

Please note, special service charges for requests that take an extraordinary time to fulfill have been part of the OPRA process since its inception. The volume and complexity of OPRA requests requiring redaction in Pompton Lakes have dramatically increased this year and have strained municipal resources. Greater care is being taken to implement special service charges when applicable.

There is no such document for your request for "Modified OPRA reply of 2024 gross salary/pay and OT totals broken down by police officer name."

What forms of payments does the borough accept for
OPRA responses, and do OPRA payments need to be split up according to OPRA, or can the payments be combined?

Additionally, if the request takes less time than quoted, will the balance be adjusted to reflect it?

The Borough will accept payment in the form of Check, Money Order or Cash. In accordance with OPRA the Borough requires a 50% payment in advance before work will begin. Please note responsive records will be released upon clearance of check.

This special service charge applies because fulfilling your request requires an extraordinary expenditure of staff time and effort, as permitted by New Jersey law, N.J.S.A. 47:1A-5.c.
This request is considered "extraordinary" because no prior requests for these specific records with the "required redactions" have been made.
