Hello,
You submitted an Open Public Records Act (OPRA) Request Form to Denville
Township which was received by the Municipal Clerk on 05/10/2024. Pursuant
to the Act, the Township has 7 business days, beginning the day after
receipt of the request by the Records Custodian, within which to respond.
Please accept this email as the Township of Denville’s respond to your
Open Public Records Act request for “All records associated with the 2023
Sergeant’s and Lieutenant’s Promotional Processes. All candidates, all
associated candidate scores, individual breakdown, ordinal scores, and
calculations for each candidate’s score.”
Be advised that your request for “All records associated with the 2023
Sergeant’s And Lieutenant’s Promotional Processes” is overbroad and
invalid under OPRA because it fails to identify specific records and
would require the custodian to exercise discretion that is not
contemplated by OPRA. A valid OPRA request must “identify with . . .
specificity or particularity the government records sought.” MAG Entm’t,
LLC v. Div. of Alcoholic Beverage Control, 375 N.J. Super. 534, 546 (App.
Div. 2005).
Records responsive to your request for “All candidates, all associated
candidate scores, individual breakdown, ordinal scores, and calculations
for each candidate’s score” are exempt from disclosure because they
constitute “personnel records” within the meaning of N.J.S.A. 47:1A-10.
The Township is precluded from releasing such records.
